Federal Judge Disciplined for Sex in Chambers, Identity Kept Secret

CNBC reported Monday that a sitting federal judge has been formally sanctioned for engaging in sexual activity inside their courthouse chambers with a high-ranking law enforcement officer. The misconduct occurred during work hours and was audible to nearby staff.

Disciplinary Panel Upholds Federal Judge Misconduct Finding

The Committee on Judicial Conduct and Disability of the Judicial Council of the United States issued its ruling last Friday. The seven-judge panel affirmed an earlier misconduct determination made in February by the Judicial Council of the 11th Circuit. That circuit oversees federal district courts across Alabama, Georgia, and Florida. The judge’s identity and precise district remain sealed.

Sanctions imposed on the judge include writing personal apology letters to six former law clerks. The judge must also forfeit any opportunity to serve as chief judge in their district. Additionally, they are barred from sitting on any Judicial Conference committee.

How the Investigation Unfolded

A complaint first reached 11th Circuit Chief Judge William Pryor last September. It originated from a memorandum passed up through the district’s own chief judge. One of the subject judge’s law clerks was the original source.

That clerk described repeated incidents of sexual activity between the judge and a uniformed officer inside the chambers during business hours. The clerk also alleged the judge failed to supervise or mentor clerks adequately, displayed volatile behavior including yelling and cursing, and once referenced heavy drinking the previous evening at a district attorney event.

When initially notified, the judge flatly denied all allegations, characterizing them as baseless and outrageous. A special investigative committee was then assembled. It interviewed former clerks, reviewed security footage and visitor logs, and conducted forensic testing of a couch cushion in the chambers. Investigators even recreated sound conditions in a room with a similar layout to assess what staff could realistically hear.

Background: Judicial Misconduct Process and Transparency Concerns

Federal judges in the United States hold lifetime appointments and are governed by the Code of Conduct for United States Judges. Misconduct complaints are handled internally by circuit judicial councils before escalating to the national committee. Critics have long argued the process lacks public transparency. Withholding a disciplined judge’s identity is unusual and has drawn fresh scrutiny here.

The Administrative Office of the US Courts declined to comment on either the ruling or the decision to suppress the judge’s name.
